Cremated remains must be placed in a plastic bag inside a hard container provided by the crematory or the next of kin before being delivered to the funeral home or the next of kin.

A biodegradable bag must be used if cremated remains are placed in a biodegradable container. Cremated remains may be placed immediately into a container ready for dispersing if the next of kin approves in writing.

A crematory cannot accept a casket or cremation container that exhibits bodily fluid leaks from the human remains. Additionally, it is not permitted to store human remains for cremation unless they are in a closed coffin for the individual or a hard container for cremation made of flammable material that safeguards both the dignity of the human remains and the safety of the crematory staff. Human remains yet to be embalmed must be stored at or below 38 degrees Fahrenheit or in compliance with applicable public health regulations.

Who Has The Authority To Order Someone’s Cremation?

The next-of-kin is typically the one who authorizes a cremation. This person is known as the authorizing agent in some states. The agent must sign an authorization document or statement for the disposition of cremated remains before the cremation can occur. The document is known as a Cremation Authorization Form.

The next of kin might be the deceased’s spouse, parents, adult children, siblings, adult grandchildren, nephews or nieces, maternal grandparents, paternal grandparents, adult aunts or uncles, first cousins, or any other adult relative with a blood connection. All children must concur and sign the cremation authorization form if there are many legal next of kin, such as when a parent passes away and several children are left to prepare for the funeral.

What Exactly Does A Crematorium Permit Entail?
